Terms of Service

1. Acceptance

By using GramFetch (“Service”), you warrant you can form a binding agreement and will comply with local law—including copyright, telecom, scraping, impersonation restrictions, minors' protection rules, sanctions & export statutes. If you disagree with any clause, discontinue use promptly.

2. Independent service

GramFetch is not provided by Meta, Instagram, WhatsApp or Threads. Trademarked names illustrate compatibility only—no sponsorship or endorsement implication.

3. Licence to use Site content

You receive a revocable personal, nonexclusive, nonsublicensable limited licence to read articles and operate open UI tools for lawful purposes consistent with robots.txt allowances. Automated bulk harvesting of full article corpora without written permission violates these terms absent fair dealing / fair use defences independently applicable to you—not extended by GramFetch as legal advice.

4. Prohibited Conduct

• Harvesting Instagram private restricted content illicitly;
• Infringing third-party copyrights, publicity/privacy torts;
• Distributing malware, disruptive packets, deceptive UI overlays;
• Reverse engineering binaries we host or circumventing DRM except where interoperability law explicitly permits;
• Impersonating staff, spoofing forged legal process;
• Fraudulent ad engagements (clickbots, deceptive impressions);
• Exploitation of minors;
• Attempting undue load / DoS contrary to proportional technical norms.

5. Downloads & redistribution

Obtaining a binary copy through our downloader does not license commercial republication carte blanche—you must clear rights yourself. Repeated abuse may trigger rate limits or revocation of access fingerprints.

6. Disclaimer of warranties

The Service is provided “as-is” & “as available.”

To fullest extent permissible: no implied warranties of merchantability fitness for purpose quiet enjoyment accuracy non-infringement uninterrupted error-free uptime or fitness for regulatory compliance regimes you might face. Instagram feature churn can degrade functionality—we attempt timely fixes yet cannot forecast third-party breakage.

7. Limitation of Liability

Except where law does not allow it, our aggregate liability for damages arising from your ordinary use of the Service over any rolling twelve-month period is limited to the greater of $100 USD or the amounts you prepaid for paid features on GramFetch (we currently bill no recurring premium plans). Some jurisdictions may not allow certain limitations; those limits apply only to the maximum extent permitted.

To the extent permitted by law, we are not liable for indirect, incidental, special, punitive, consequential, lost profit, reputational harms or data-loss damages tied to intangible expectations.

8. Advertising

Monetization may use Google AdSense or similar networks. Separate disclosures in our privacy policy explain cookies and opt outs. Fraudulent impressions, invalid clicks intended to inflate revenue dishonestly, or other abuse aimed at harming the ad ecosystem may result in suspension of access alongside whatever remedies partners pursue.

9. Indemnification

Where permitted by law, you agree to defend, indemnify, and hold harmless the operators of GramFetch from reasonable third party claims, losses and expenses (including legal fees where recoverable) that arise because you broke these Terms or used the Service in ways that harmed others—including copyright litigation driven by unauthorised republication beyond personal fair dealing rights you alone must establish.

10. Changes & Suspension

We may update or suspend features—including the downloader—for maintenance, abuse prevention, compatibility with evolving Instagram behaviours, regulatory orders, security incidents or product strategy. Meaningful contractual changes ship with date stamps on this page whenever feasible.

11. Miscellaneous

These Terms, together with our Privacy Policy and Disclaimer & editorial policy, explain how you may use the Site. If a court finds part of these Terms invalid, the rest stays in force where permitted. We may revise these Terms occasionally; continuing to use GramFetch after we post updates generally means you accept the revised version, except where your local law requires a different consent process.
